The GT40 Enthusiasts Club (the Club) respects your privacy and we will only use your information in the way we describe in this notice. When using your information, we aim to be fair and transparent, and to follow our obligations under UK data protection laws. Your information is used for administering club membership and activities.

In this privacy notice, we describe our privacy policy. We seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our Sites or Apps and our services.

This privacy policy applies to all information collected through our website (such as https://www.gt40enthusiastsclub.com/), mobile application, (“Apps”), and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the “Sites”).

Please read this privacy policy carefully as it will help you make informed decisions about sharing your personal information with us.

The GT40 Enthusiasts Club is the data controller for the purpose of GDPR and the Data Protection Act 2018. The GT40 Enthusiasts Club contact for privacy and data is the membership secretary, who can be contacted by email on [email protected]

1       Collecting your information

We collect personal information that you voluntarily provide to us when registering at the Sites or Apps, expressing an interest in obtaining information about us or our products and services, when participating in activities on the Sites or Apps or otherwise contacting us.

The personal information that we collect depends on the context of your interactions with us and the Sites or Apps, the choices you make and the products and features you use.

The information you give us may include your contact details (name, address, telephone number, email address), personal identifiers (membership number), and other information (vehicle details). When you give us information about another person as an emergency contact you should let that person know that you have given us the information.

2       Storage of Information

The data you provide us is stored in a password protected electronic database. Where the data is provided by means of a paper membership application form this is transferred to the database and your paper application form is destroyed. Updates to your information are performed directly onto the database. The database is stored in UK based data centres. Regular backups of this data are taken by the membership secretary and stored on a secure private computer.

The club does not store any Member bank, building society or PayPal account details on its database, nor any other sensitive personal data. All payment information you provide is entered directly into the system of our payment processing partners and you should satisfy yourself with their privacy policy as the club is not responsible for information you share through their payment processing system.

The club does store details of when payment transactions are made (date, amount, reference id) to enable us to manage membership renewals and investigate transactions with our payment partner on your behalf.

If you decide to choose the automatic renewal option for your subscription with payment by credit or debit card via the Stripe payment processing option then we will store the last 4 digits of your card number and the expiry date.  This is so we can send you reminder emails when your card is about to expire so you can update the details in Stripe via your member dashboard.

You may enter details of your car into the club registry. This is stored in a database alongside the membership data.  If you leave the club or sell your car the club will retain details of the car within the registry but will remove your ownership information. Where a car is transferred to another club member then the club can arrange for ownership of the registry entry to be updated.

3       Information automatically collected

Some information – such as IP address and/or browser and device characteristics – is collected automatically when you visit our Sites or Apps.

We automatically collect certain information when you visit, use or navigate the Sites or Apps. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Sites or Apps and other technical information. This information is primarily needed to maintain the security and operation of our Sites or Apps, and for our internal analytics and reporting purposes.

4       Using your information

We use your information when you first apply to become a member of the Club and then to administer and renew your club membership and provide you with member benefits. We also use your information when you participate in club events and meetings. Your information is used in these ways to fulfil our contract with you.

We feature a new member list in Fortyfication magazine every quarter, where your name, town and country of residence will be published.

For distribution of the Fortyfication magazine a mailing list is provided to the magazine editor on a quarterly basis which contains your postal address (membership number, name, postal address) to enable a mail merge to be performed to address envelopes. This is sent via email as a read-only, password protected file.

The club sends local member contact information to regional organisers monthly, and to event organisers where you have shown an interest in an event. This information will include your membership number, name, email address, postal address and telephone number. This is sent via email as a read-only, password protected file. You will only be included in this distribution  if you have agreed that we can do this by giving us your clear consent as part of the membership process – and you can change your mind at any time by unsubscribing and you will then be removed from the next contact information distribution.

We will use your information to send you newsletters and event information by email, but only if you have agreed that we can do this by giving us your clear consent as part of the membership process – and you can change your mind at any time by unsubscribing from our newsletters. We will not sell your information to another organisation.

We will show your address location on a map (Full Name) which can be accessed by other members logged onto the website, but only if you have agreed that we can do this by giving us your clear consent as part of the membership process – and you can change your mind at any time by unsubscribing from inclusion of your information on the map.

If you add any items for sale please be aware that all details you enter, including location and contact details, are available to any visitor to the website and not just to logged in members.

We may ask you for emergency contact and next of kin details which we will only use in an emergency, or for a legitimate interest in association with participation in a club event. You should let the contact and next of kin know that you have given this information to us. These details will be destroyed after the event which they have been collected for has ended.

To support your lifetime relationship with the Club we may keep your information indefinitely in offline data backups, unless you ask us to fully delete it. After your membership has expired we will contact you to renew your membership up to 3 months after expiry, after this 3 month period you will no longer be contacted and your membership record will be deleted from the club website membership electronic database.

When your membership record is deleted, details of any cars that you have added to the club registry or items that you have added for sale will be retained so they are still available for other members to view. They will however not be linked to your membership record and will then only be editable by a website administrator.  Any forum posts that you have made will be retained and allocated to a Non-Member account.  If you would like your forum posts deleted then you must advise the Membership Secretary that you intend to leave the club before the 3 month non-renewal period is reached so they can be deleted before they are allocated to the Non-Member account.

5       Sharing your information

We may share your information with club service providers, for example, sendinblue for bulk email distribution, Branded for web site administration and support services.

We require any third party, to which we may send your contact details, that provides the club with services, to satisfy us that your data will be held securely and used only for the purposes we have authorised.

The club does not use the Member or Car registry database for direct marketing or profiling, nor does it make records from the database available to club members for these or any processes other than those described above.

If you purchase club merchandise from Logo That Polo they will collect information from you to process your order.  This information will be stored in line with their Privacy Policy which you can read at https://logothatpolo.co.uk/privacy-policy/ . On a scheduled basis Logo That Polo will pass to the club, via a secure file sharing service, details of purchases made that include Name, Membership Number and total order value.  This is so that we can validate club member purchases and record total value of the club merchandise goods sold.

The club website might contain links to other websites such as online entry and payment sites, partners, and advertisers. If you follow links to other websites, please review the privacy policy for each site because we are not responsible for information you share on those sites.

Your information is held securely by us. We have taken all reasonable steps and have in place appropriate security measures to protect your information. Your information is not transferred outside the European Economic Area.

However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, the transmission of personal information to and from our Sites or Apps is at your own risk. You should only access the services within a secure environment.

9       Children & Privacy

Our websites do not target and are not intended to attract children under the age of 18. The club does not knowingly solicit personal information from children under the age of 18 or send them requests for personal information.

10   CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practise in a revised version of this Privacy Policy.

11   DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Sites or Apps, you have the right to request removal of unwanted data that you publicly post on the Sites or Apps. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Sites or Apps, but please be aware that the data may not be completely or comprehensively removed from our systems.

12   Your rights

You may contact the club either by letter to the Club address (which can be found in the most recent edition of Fortyfication magazine) or by email to the Club membership secretary as detailed in the second paragraph and we will respond to you within 28 days of your request:

  1. a) You are entitled to a copy of the information we hold about you, and to ask us to correct any inaccuracies.
  2. b) You may ask us to stop using your information, and to delete it. If you ask us to do this, we will not be able to continue our contract with you and you will be deemed to have terminated your membership of the club.
  3. c) You may make a complaint to the Information Commissioner (www.ico.org.uk).

You may also perform the following actions yourself through the website membership portal:

  1. a) You can update your information yourself via the club website.
  2. b) You can view and edit the information stored about you by logging into the club website and editing through the member dashboard.
  3. c) You may change your contact preferences for optional services at any time and this will take affect the next time the club undertakes the associated service, unless it relates to the membership map where your details will be added/removed immediately.
